When your workers' compensation application is denied or your benefits are discontinued, the appeals process can become very complicated very quickly. Because of our experience, we understand all the procedures and strategies for getting you the benefits you need.
Generally, once you have filed a workers' compensation claim, your employer will respond in one of two ways:
- Denial of benefits. Your employer must notify you within 21 days. The denial can be for a number of reasons, including failure to notify, failure to meet the requirements to demonstrate that the injury was work related, or failure to file before the statute of limitations ran out.
- Notice of Compensation Payable. Your employer may send you notice that you will receive benefits. You want to be careful to clarify the nature of the benefits.
