Protecting Your Workers' Compensation Claim

If you have suffered a job injury, there are certain steps you want to take:

  • Notify your employer. You must immediately notify your boss or supervisor when you have been injured or when you first notice the effects of an injury, such as repetitive stress. Your employer then has 20 days to let you know that you will receive benefits.
  • Seek medical attention. It is important to go to a doctor as soon as possible, so that you can document both the cause and the extent of your injury.
  • File a claim. If your employer fails to notify you within 21 days or wrongfully denies your claim, you will need to file your own claim. You can do this yourself, but it is often in your best interests to hire an attorney to assist you with this.
  • Avoid signing anything! Your employer may try to get you to waive your rights in exchange for the payment of some expenses or compensation. Don't sign anything until you talk to a lawyer. You may forfeit some or all of your rights.
  • Contact an attorney. Whenever you are uncertain about your rights, you should contact an attorney. At our office, we handle all workers' compensation job injury claims on a contingent fee basis. We won't charge you any attorneys' fees unless we recover compensation for you.
